Terms of Use

These Terms of Use (“Terms”) form a binding agreement between you (“User,” “you”) and MERCA Entertainment (“we,” “us,” or “our”) and govern your use of our mobile applications: Mitosis, Chroma, and Rovonot (collectively, the “Apps”).

By downloading, installing, or using any of the Apps, you confirm that you have read, understood, and agree to these Terms.

1. License Grant

Subject to your compliance with these Terms, we grant you a personal, limited, non-exclusive, non-transferable, non-sublicensable, revocable license to download, install, and use the Apps on devices that you own or control, for your personal, non-commercial use only.

This license is provided by MERCA Entertainment, not by Apple or Google. Your use is also subject to the Apple App Store Standard EULA or Google Play Terms of Service.

2. Prohibited Conduct

You agree NOT to:

Reverse engineer, decompile, or disassemble the Apps (except as permitted by law)
Modify, adapt, translate, or create derivative works
Use cheats, mods, automation, or bots
Use the Apps for commercial purposes without our written permission
Use the Apps in violation of any law or third-party right
Use the Apps to harass, threaten, defame, or harm any person
Remove, alter, or obscure copyright or trademark notices
Distribute, sublicense, sell, rent, or transfer the Apps
Use automated scraping or data-mining
Use the Apps if you are under the minimum age in your jurisdiction (see §8)

3. Intellectual Property

All content in the Apps is the exclusive property of MERCA Entertainment or our licensors, protected by Turkish, EU, US, and international IP laws.

“MERCA Entertainment,” “Mitosis,” “Chroma,” “Rovonot” and associated logos are trademarks of MERCA Entertainment.

You retain rights to your own original content (screenshots, gameplay videos, fan art). Commercial use requires our prior written consent. Non-commercial sharing on social media and streaming platforms is permitted.

4. User Content

The Apps do not currently accept user-generated content. If we add such features, additional terms will apply.

5. In-App Purchases

The Apps do not currently offer in-app purchases. If we introduce them, additional terms will apply, and refunds will follow platform policies and applicable consumer-protection law.

6. Updates and Modifications

We may update, modify, or discontinue any App or feature at any time, with or without notice.

7. Disclaimer of Warranties

THE APPS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, TO THE FULLEST EXTENT PERMITTED BY LAW. We do not warrant that the Apps will be uninterrupted, error-free, or secure.

Nothing in these Terms excludes liability for fraud, gross negligence, willful misconduct, or any liability that cannot be excluded under applicable law.

8. Eligibility and Age Restrictions

You must be at least 13 years old to use the Apps. If you are between 13 and the age of majority in your jurisdiction, you confirm that a parent or legal guardian has reviewed and agreed to these Terms.

In jurisdictions where the digital-consent age is higher (e.g., 16 in some EU Member States under GDPR), you must meet that threshold.

9. Limitation of Liability

To the maximum extent permitted by law, MERCA Entertainment shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, including loss of profits, data, or goodwill, arising out of or related to your use of the Apps.

Our total cumulative liability shall not exceed the greater of (a) the amount you paid us, if any, in the twelve (12) months preceding the claim, or (b) ten US dollars (US $10.00).

The limitations above do not apply to liability for death, personal injury, fraud, or any liability that cannot be limited under applicable law.

10. Indemnification

You agree to indemnify, defend, and hold harmless MERCA Entertainment and its officers, employees, contractors, and licensors from any claims arising out of your use of the Apps in violation of these Terms, your violation of any law or third-party right, or your misuse of the Apps.

11. Termination

We may suspend or terminate your license at any time for breach of these Terms. Upon termination, you must cease all use of the Apps and delete all copies. Sections that by their nature should survive (§3, §7, §9, §10, §12, §14) will survive.

12. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Türkiye. Disputes shall be brought exclusively in the Istanbul Central (Çağlayan) Courts and Enforcement Offices, except where mandatory consumer law in your country provides otherwise. EU consumers may also bring proceedings before the courts of their domicile.

13. Changes to These Terms

We may amend these Terms from time to time. Material changes will be announced on https://mercaentertainment.com.

14. Miscellaneous

Severability: If a provision is unenforceable, the rest remain in full effect
Entire agreement: These Terms + Privacy Policy constitute the entire agreement
No waiver: Our failure to enforce does not waive future enforcement
Assignment: You may not assign; we may assign to a successor entity
